In the week that Interbrand names Coke the most valuable brand in the world (for the umpteenth year) the company has lost its latest patent infringement claim against Pepsi Co. Coke has successfully sued Pepsi twice already in relation to its collapsible syrup packaging but failed to obtain a third judgment against Pepsi in relation to that company's replacement packaging. The court found that "substantial differences exist" between the patented packaging and Pepsi's new packaging and therefore Coke had failed to establish a necessary element of its infringement claim.
Those of you reading this in the waterlogged areas of the UK might be interested to note that other than cleaning pennies, the only other redeeming feature this product has is that flat Coke is an excellent drink to have before going anywhere with potentially bad/polluted water. Something in it seems to prevent upset tummies and the like. If you decide to try this preventative measure out for yourself just remember to use what fresh water you have to clean your teeth more frequently.
