Background
Ryanair Limited has successfully obtained the ryanair.org.uk domain name from a disgruntled customer.
Michael Coulston had set up a "Ryanair Refund Campaign" website using the domain name and, not surprisingly, Ryanair took action. It invoked the dispute resolution procedure of Nominet's and the matter was referred to an independent expert, Anna Carboni, for determination. Ms Carboni found in Ryanair's favour. Comment
Ms Carboni's decision is interesting for noting that a brand owner cannot be expected to register every possible domain for its brand simply as a defensive measure.
It is also interesting to note that challenging a domain name doesn't necessarily solve the problem. Whilst Ryainair secured the domain, Mr Coulston has actually set up a new web site to carry on his campaign.
